The Councilor for Consumer Affairs, Ana Maria Molina, recalled that, from the Municipal Office of Consumer Information (OMIC) of the city, dependent on its Department, free advice is being offered to people affected by land clauses.
We recall that the Court of Justice of the European Union has issued a judgment of December 21, 2016, establishing total retroactivity on abusive ground clauses: banks that have applied must return all money improperly charged under this clause from the date Formalization of the contract.
From the Consumer Office we are reminded of some tips to be followed by the consumer before the floor clauses, and to advise through this office before going to court if they have any of these indications.
1 ° These floor clauses are usually included in contracts with variable interest.

If you continue to have a clause, or as a result of a claim or a court sentence, they have been deleted, but you have not returned any economic amount.
3 ° If they have been canceled and have returned an economic amount, but not since its initial inclusion, in the mortgage loan agreement.

The consumer on a voluntary basis may avail himself of the out-of-court settlement procedure.
5 ° The consumer must complain in writing to the customer service of the banking institution concerned (which must be resolved within a maximum period of one month).
If this is not the case, the OMIC is preparing a form so that the consumer can thus request the return of the amounts wrongly received from the beginning of the contract.
This form will have to be sealed by the bank and then left in the OMIC for its processing in the Customer Service of the Entity.
6 °.
The maximum period for the consumer and the banking entity to reach an agreement and make available to the first the amount to be returned, shall be THREE MONTHS from the date of filing the claim.
The consumer is entitled to reimbursement of all sums paid improperly from the signing of the ground clauses until their disappearance, regardless of whether the contract is in force, or has been previously canceled and is no longer in force.
For any claim that citizens of Cehegín want to make, they can go to this Office, located in the Begastri Street (Building of the Municipal School of Music) from 11:00 a.m. to 2:00 p.m., from Monday to Friday.
