The City Council of Cehegín, as dictated by the final judgment of the Contentious Administrative Court last April, will have to return to the Residence Argos Sol SL, the amount of 315,594.22 euros.
This merchant filed, in its day, a lawsuit against the ceheginero consistory on the resolution of the agreement signed between both parties in 2006. In this way, the City will have to return, not only the amount of 269,195.54, which was on its day delivered by Argos Sol to the municipal coffers, but also the legal interests from the date of request for resolution of the agreement.
Thus, the ruling of May 17, 2017, which estimated the demand for contentious administrative appeal of Argo Sol SL, annulling the municipal dismissal and agreeing on the resolution of the urban agreement signed between the parties is made firm.
The appeal and cassation appeals lodged by the City Council of Cehegín have been dismissed by the Superior Courts of Justice and Supreme Courts.
The Mayor of Cehegín, José Rafael Rocamora, explained that "this nonsense, inherited from the old Popular Party corporation, has been one of the obstacles we have encountered throughout the legislature"
"Fictitious urban agreements, has continued to clarify the Mayor, undeveloped, sold as smoke as the Argostea, which now must pay all cehegineros and cehegineras with their taxes"
"A money contributed by companies in their day, like this one now, has continued to qualify the Mayor, which the City Council has already spent, as it did with the money from the Auditorium, which came from the Community. only in the present and for his own benefit, which will now have an impact on the pocket of all the citizens of Cehegín "
We would like to remind you that the agreement with Argo Sol SL, in 2006, augured, as the City Council stated in its day, a future development located next to the Argos reservoir.
"This complex, it was argued, will have a total of 600 homes, will allocate 10 percent of the developable land to commercial uses, such as shops, restaurants and leisure areas." 5 percent will go to single-family homes, ie, detached houses while the remaining 85 percent will be used for grouped homes, which will have an innovative design, and ARGOSOL will have numerous green areas, such as parks and gardens, and their necessary equipment areas. "
It was even presented, as it was also explained in his day, "to the public at the Real Estate Exhibition of Madrid 2007 (SIMA), having a great acceptance in this contest, since it is the only project of its kind projected throughout the Region of Murcia "
José Rafael Rocamora has continued explaining that "this policy of selling what there is not, fireworks, has made us, over time, as now has happened, puts us in the harsh reality." And this is no other than, the amounts that these companies deposit in the municipalities for the development of these agreements, have to be returned in the end ".
The Mayor of Cehegín concluded that "this way of acting was a constant in Cehegín with the Popular Party Government, installed in a policy of" anything goes ", harmful to the future of our municipality and its economic development"
